1. What Wayly is, and what it is not
Wayly is an information and organisation tool for people using or considering Support at Home and related aged-care services in Australia. We help you understand options, organise paperwork, check statements, and ask better questions.
Wayly is not:
- a registered aged-care provider under the Aged Care Act 2024
- a financial adviser, financial product issuer, or credit provider
- a legal practitioner or migration agent
- a registered health practitioner, medical device, or healthcare provider
- a substitute for advice from any of the above
Everything Wayly produces, including answers from our AI tools, is general information only. It is not financial, legal, medical or aged-care advice. Before you act on anything you read or generate in Wayly, check it with a qualified professional who knows your circumstances. If a decision matters, verify it.
2. Definitions
- Wayly, we, us, our: Wayly Pty Ltd (ACN 701 311 373, ABN 66 701 311 373), the company that operates wayly.com.au and the Wayly app.
- You, your: the person who has agreed to these terms and holds a Wayly account.
- Service: the Wayly website, mobile app, AI tools and any related features we make available.
- AI outputs: any text, summary, checklist, draft or answer generated by our AI tools in response to what you enter.
- General information: information provided for your understanding and organisation — not personal advice, and not a recommendation to take a specific action.
- ACL: the Australian Consumer Law, in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
- Support at Home: the Australian Government’s in-home aged-care program under the Aged Care Act 2024.
3. Your account
To use Wayly you need to be at least 18 years old and able to enter a contract under Australian law. You agree to:
- give us accurate information when you sign up and keep it current
- keep your login details private and not share your account
- tell us promptly if you think someone else has accessed your account
- use Wayly only for lawful purposes
You are responsible for everything that happens under your account.
4. Using Wayly responsibly
You agree not to:
- use Wayly to make decisions on behalf of another person (including a parent, partner or care recipient) without verifying the output with a qualified professional and, where relevant, that person’s consent
- enter another person’s personal or health information into Wayly without their consent or proper legal authority
- use Wayly to give advice to third parties as if it were your own professional opinion
- attempt to reverse engineer, scrape, copy or resell any part of the Service
- use Wayly to harass, defame or harm anyone
- upload anything unlawful, infringing or malicious
We may suspend or close your account if you breach these rules. We will tell you why, except where doing so would itself be unlawful.
5. AI outputs and verification
Wayly uses AI to generate answers, summaries, checklists and drafts. AI can be incorrect, out of date or missing local context, and it can sound confident either way. You agree that:
- AI outputs are general information, not advice
- you will read AI outputs critically and verify anything you intend to rely on
- you will not treat AI outputs as a final answer on funding, eligibility, clinical care, legal rights, tax, or anything else with real consequences
- if an AI output conflicts with information from My Aged Care, Services Australia, your provider, your doctor, your accountant or your lawyer, the official source wins
Australian data residency: Wayly’s AI inference runs on infrastructure hosted in Australia. Your inputs are not shared with third-party AI vendors for their own model training. We do our best to make Wayly accurate and useful, but we cannot and do not guarantee that outputs will be correct, complete or current.
6. Data and privacy
Our Privacy Policy explains how we collect, use, store and disclose personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles. In summary:
- your data is stored in Australia
- we do not sell it
- we do not use it to train third-party AI models
- we may use de-identified, aggregated data to improve the Service
- if you close your account, we delete your personal data within 30 days, except where we are legally required to keep records (for example, financial records under the Corporations Act 2001 (Cth), or material under a legal hold). Backup copies are overwritten in the normal course within 90 days.
7. Your content
You keep ownership of anything you put into Wayly, including your questions, uploads, documents and notes (“Your Content”).
You grant us a non-exclusive, royalty-free licence to host, store, process, display and transmit Your Content to the extent needed to provide the Service to you. This licence ends when you delete the content or close your account, subject to backup and legal retention as described in clause 6. You confirm that you have the right to give us this licence and that Your Content does not breach any law or another person’s rights.
8. Feedback and ideas
If you send us feedback, suggestions or feature ideas, you agree we can use them in the Service without any obligation, payment or attribution to you. This does not give us any rights over Your Content beyond the licence in clause 7.
9. Subscriptions and billing
- Plans are billed fortnightly in advance (26 charges per year), in Australian dollars, including GST where applicable. Current pricing is on our pricing page.
- Free trials are one per person and do not require a card. Before your first paid charge at the end of a trial, we send a single reminder email. Subsequent charges receive a receipt after the fact.
- You can cancel any time from your account settings. Cancellation stops your next renewal, and you keep access until the end of your current billing period.
- Upgrades take effect immediately and are prorated to the day. Downgrades and removals take effect at the end of your current billing period. We do not refund or credit part-used periods, subject to your rights under the ACL (clause 14).
- If we change pricing, we will give you at least 30 days notice by email or in-app before it applies to your next renewal.
- Payments are processed by Stripe. If a payment fails, we will retry and let you know. If it remains unpaid, we may suspend access until it is resolved.
10. Refunds and consumer rights
We do not generally refund part-used billing periods when you cancel or downgrade. This is our commercial position, not a limit on your legal rights. If the Service is faulty, misdescribed, or fails to meet a consumer guarantee under the ACL, you may be entitled to a repair, replacement, refund or compensation (see clause 14 and our complaints process).
11. Our content and intellectual property
Wayly’s software, design, written content, prompts, brand, and any AI outputs generated for you (to the extent capable of protection) belong to us or our licensors. You may use Wayly for your own personal, family or professional purposes as set out in your plan. You may not copy, redistribute, sublicense, or build a competing product from any part of the Service.
12. Third-party services
Wayly may link to or reference government services (such as My Aged Care and Services Australia), aged-care providers, health services, or other websites and products. We do not control them and are not responsible for their content, availability or accuracy — their terms and privacy policies apply when you use them. Payments are processed by Stripe, and Stripe’s terms apply to the payment itself.
13. AI accuracy and liability
To the maximum extent permitted by law, and subject to clause 14:
- the Service is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free, or fit for any particular purpose beyond what we describe on the site
- we are not liable for loss or damage arising from your reliance on AI outputs or general information from Wayly
- we are not liable for indirect, consequential or special loss, including lost income, lost opportunity, or loss of data
- our total liability to you in any 12-month period is capped at the fees you paid us in that period, or AUD $100 if you paid nothing
14. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, that cannot lawfully be excluded. Where our liability for breach of a non-excludable consumer guarantee can be limited by law, our liability is limited (at our option) to resupplying the Service or paying the cost of resupply.
15. Beta features
From time to time we may make features available marked as “beta”, “preview” or similar. These are provided for testing and feedback, may change or be withdrawn at any time, and may not be as reliable as the rest of the Service. Use them on that basis.
16. Events outside our control
We are not liable for any delay or failure to perform our obligations caused by events outside our reasonable control, including natural disasters, network outages, cyber attacks, acts of government, or third-party service failures. We will take reasonable steps to restore the Service as soon as we can.
17. Changes to these terms
We may update these terms from time to time. If a change materially affects you, we will give you at least 30 days notice by email or in-app before it takes effect. If you keep using Wayly after the notice period, you accept the change. If you do not accept it, you can cancel your account before it takes effect. Non-material changes (such as fixing typos or clarifying wording) take effect when we publish them. The “Last updated” date at the top of this page shows when the terms last changed.
18. Ending the agreement
You can stop using Wayly and close your account at any time from your account settings. We can suspend or close your account if you breach these terms, if we are required to by law, or if we discontinue the Service. If we discontinue the Service, we will give you reasonable notice and refund any prepaid unused period on a pro-rata basis. Clauses that by their nature should continue after the agreement ends (including intellectual property, liability, data retention and governing law) will continue.
19. Notices
We will send legal notices to the email address on your account. You are responsible for keeping that email address current. You can send notices to us at hello@wayly.com.au. Notices are treated as received the next business day after sending.
20. Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
21. General
- If any part of these terms is unenforceable, the rest stays in force.
- Our failure to enforce a right is not a waiver of it.
- You cannot transfer these terms to anyone else. We can transfer them to a related entity or to a buyer of our business, on notice to you.
- These terms, together with our Privacy Policy, are the whole agreement between us.
22. Complaints and disputes
If you have a concern about Wayly, please contact us at support@wayly.com.au. We aim to acknowledge complaints within 2 business days and to respond substantively within 10 business days. If we cannot resolve your concern, you can raise it with an external body, depending on the issue:
- Privacy: the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au
- Consumer issues: Consumer Affairs Victoria at consumer.vic.gov.au, or the ACCC at accc.gov.au
- Aged-care service quality (with a provider, not Wayly): the Aged Care Quality and Safety Commission at agedcarequality.gov.au
